How to find out if you need planning permission

Not all development requires planning permission - some comes under what is known as 'permitted development' which means it doesn't require an application for planning permission. You can find informal guidance on common projects on the Planning Portal website and use the interactive guide to help find out whether what you propose will need an application for planning permission or not.

Planning permission may be required to change the use of a building or plot of land. A list of current use classes can be found within planning use classes 

It is your responsibility to ensure you apply for planning permission if it is required.

I don't live in a listed building or conservation area. How do I find out if I need planning permission?

You can refer to the informal guidance on the Planning Portal. If you need us to answer the question ‘do I need planning permission’ or you just want formal confirmation, you can apply for a Certificate of Lawful Development. The certificate will give you a legally binding answer on whether the work you plan to do would need planning permission or not. This may be a useful document if you ever need to prove that something did not require permission e.g. when selling your home. 

We can only answer questions on whether Planning Permission is required through this formal process.

I don't live in a listed building, but my home is in a conservation area. Do I need planning permission?

You can refer to the informal guidance on the Planning Portal - this does include the additional restrictions that apply in conservation areas. 

If your home is located in a conservation area with an Article 4 Direction, there are further controls in place and these will not be listed on the Planning Portal. Please email us at Planning@rutland.gov.uk to obtain a copy of any Article 4 Direction. See list of villages with Conservation Areas and Article 4 Directions.

I live in a listed building - do I need planning permission or listed building consent?

Listed building consent is a separate form of consent to planning permission. It may be required where planning permission is not, or it may be required in addition to planning permission. 

It is generally required for any alterations to the historic fabric (the elements that characterise the structure of the building such as walls, roofs, internal surfaces, floors, stairs, landings and all doors and windows) of the building. 

If you are unsure if listed building consent is required or would like advice before applying email us at planning@rutland.gov.uk - give as much information as you can, including:

  • a location plan
  • full address
  • details about your proposal
  • photos showing as existing

We'll register this as a preliminary enquiry (no fee will apply for enquiries relating to listed building consent only) and will get back to you within 6 weeks.
