Community Infrastructure Levy (CIL)

Introduction

The Community Infrastructure Levy (CIL) raises funds from the developers of new building projects to help pay for infrastructure needed to support the new development, as set out in:

CIL money is used to fund a variety of infrastructure, including:

  • highways
  • education
  • learning and skills
  • county sports provision
  • health facilities

CIL replaces Section 106 planning obligations for many forms of infrastructure, although Section 106 agreements can still be used for site-specific mitigation measures and affordable housing provision. 

We maintain a Community Infrastructure Levy database.

All CIL liable planning applications are placed as a charge on the Local Land Charges register until the chargeable amount has been paid in full or the clawback for any reliefs/exemptions has expired. A CON29 search will reveal information, including the planning reference numbers of CIL applications:

If a CIL charge is revealed on the Local Land Charges register, conveyance solicitors should contact our CIL officer before completing a property transaction: cil@rutland.gov.uk

You need to complete a CIL Transfer of Assumed Liability (Form 4) before the last scheduled payment if the liable party changes. For property sales, the form needs to be received before the exchange of contracts.
