Recovery action

The administration and enforcement of Council Tax is closely regulated and there are a number steps we must take when collecting payment.

       
  • We must send you a bill showing you the amount due and the instalments you should pay
  • If you fail to pay we must send you a Reminder. If you do not pay the full debt straight away, a summons is issued without any further notice

  • If you bring your account up to date after being reminded but fall behind again you will be sent a Second Reminder. If you do not pay the full debt straight away, a summons is issued without any further notice

  • If you bring your account up to date after the Second Reminder but fall behind again you will be sent a Final Notice

  • If you get a Final Notice you lose the right to pay by instalments and will be sent a Summons if you don't pay the full balance straight away

  • If a Summons is issued and you fail to pay the full balance plus costs before the court hearing date, we must apply for a Liability Order which will incur court costs

  • A Liability Order allows us to take various actions to recover the money that is owed. This may be: attachment of earnings, attachment to Benefit, use of enforcement agents, bankruptcy proceedings, a charging order on your property, committal to prison
