Road Adoptions


General
Rutland County Council is required to publish an up-to-date list of streets maintained at the public expense under section 36 of the Highways Act 1980.

The List has been prepared using the best available information from records compiled by the County Council and is correct to the best of its knowledge. The List does not, however, constitute a definitive statement as to the status of any particular highway. It is not a comprehensive list of all roads in Rutland but most are included for informative purposes.

Terms used in the List to identify the Adoption Status of a road are:

Publicly Maintainable: A highway maintained by the Highway Authority at public expense. Some indication as to the extent of the publicly maintainable highway may be included, but for more definitive extent information please contact The Land Charges Section on 01572 722577 extension 320 / 206. There may be a charge for this service.

Prospectively Maintainable: A highway that is either currently being constructed or has recently been constructed where the developer has entered into a section 38 agreement (Highways Act 1980) with Rutland County Council. When the terms of the agreement have been satisfied this agreement will be deemed 'fulfilled'. The Council will then "adopt" the road where it will become maintainable at the public expense.

Unadopted: A Highway that is not maintained by the Highway Authority at public expense.
