Decision Notices

A decision notice is issued when a decision is made on a planning application. It is a legal document which gives details of the decision and reasons for it.

In the case of an approval, conditions may be applied with which an applicant has to comply usually before the development can proceed.

You can view copies of decision notices issued from December 2005 online free of charge by searching for the appropriate application.

Alternatively, all decision notices can be ordered from Customer Services for £15 including VAT if a hard copy is required.

Please note that the reference number must be entered without the case officer's initials at the end. E.g. FUL/2007/0123/CC must be entered as "FUL/2007/0123".

 

Discharge of Conditions

Under Article 21 of The Town & Country Planning (General Development Procedure) Order 1995, any request to formally discharge a condition attached to a planning permission is chargeable.

The charge is £25 where the consent relates to a domestic proposal (e.g. extensions, alterations to a house etc) or £85 in all other cases (e.g. erection of a new dwelling, commercial development etc).

This charge will be applied to each request, regardless of the number of conditions involved. This being the case, it is in the applicants interest to include as many conditions as possible with each request.

If an applicant submits more information with the original application (e.g. about building materials, landscaping etc), the authority is less likely to have to impose conditions requiring discharge.
